Terms of Service

These Terms of Service ("Terms") govern your use of VoteUnionBot ("the Service"), an SMS-based tool that provides candidate endorsement information, operated by Matthew Fogarty ("we," "us," "operator"). By texting (888) 516-3852 or otherwise using the Service, you agree to these Terms.

1. Description of the service

VoteUnionBot is a free SMS service that returns candidate endorsement information from participating organizations when you text a phone number, address, race, or candidate name. The Service is informational only.

2. SMS messaging and consent

By texting VoteUnionBot, you consent to receive SMS messages in response to your queries. Specifically:

• You consent to receive SMS responses to each message you send.
• Message frequency varies based on your queries — typically one to three messages per conversation.
• Standard message and data rates from your mobile carrier may apply. VoteUnionBot does not charge for the service itself.
• Text STOP at any time to opt out of all messages. You will receive one final confirmation message.
• Text HELP for assistance or contact us at help@matthewdfogarty.net.
• Text START to opt back in after opting out.

Supported carriers include all major US carriers. Carrier support is not guaranteed for all MVNO or regional carriers.

3. Accuracy of endorsement information

Endorsement data is sourced from participating organizations and is provided for informational purposes only. We make reasonable efforts to ensure accuracy but:

• We do not guarantee that all endorsements are current, complete, or error-free.
• Endorsements may change after data is collected. Results reflect the data available at the time of your query.
• The absence of an endorsement result does not mean a candidate is unendorsed — it may mean their endorsement is not in our dataset.
• Endorsement data shown during the demonstration phase is fictional and for testing purposes only.

4. Prohibited uses

You agree not to:

• Use the Service for any unlawful purpose
• Attempt to overload, disrupt, or circumvent the Service
• Use automated systems to send messages to the Service
• Attempt to extract, scrape, or systematically collect endorsement data from the Service
• Impersonate any person or entity in your messages

5. Disclaimer of warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT ENDORSEMENT DATA WILL BE COMPLETE OR ACCURATE.

6. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, MATTHEW FOGARTY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, INCLUDING BUT NOT LIMITED TO RELIANCE ON ENDORSEMENT INFORMATION PROVIDED. OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING FROM USE OF THE SERVICE SHALL NOT EXCEED $100.

7. Indemnification

You agree to indemnify and hold harmless Matthew Fogarty from any claims, damages, or expenses arising from your use of the Service in violation of these Terms.

8. Privacy

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

9. Modifications to the service and terms

We reserve the right to modify or discontinue the Service at any time without notice. We may update these Terms from time to time. The effective date at the top of this page reflects the most recent revision. Continued use of the Service after changes constitutes acceptance.

10. Governing law

These Terms are governed by the laws of the District of Columbia, without regard to conflict of law principles. Any disputes arising under these Terms shall be resolved in the courts of the District of Columbia.
